Terms and conditions

These terms and conditions are valid for shopping in the Jibstarshop (www.jibstarshop.com) webshop. Terms and conditions specify more closely rights and obligations of the seller (jibstarshop) and the buyer (customer). These Terms and conditions create in there current version the content of purchase contract, which is created between the seller and the customer.

By sending the order, the buyer is confirming, that he agrees with these Terms and condition and that these will be regulating all the relations between the seller and the customer by agreeing on the contract and by any returns of the goods.

Orders
All orders created on the www.jibstarshop.com websites are binding for both sides. By sending the order the customer confirms, that he is familiar with these Terms and conditions and with the return conditions. The order acceptation will be confirmed by an email. The seller has to right to refuse an order from a customer, which has not payed for the goods in the past. The order can be cancelled by the customer anytime before receiving the confirmation email. The buyer is responsible for any damages, which may happen to him when he misuses the webshop.
The seller has the right to cancel the order in case:
- when buyer does not fill the contact informations correctly
- the goods are not on stock
This fact will be sent to the customer by an email without any unnecessary delay.

Price
Price is always listed by the certain products. All the prices are listed in their end value. The shipping costs will be added to the price depending on the shipping method. If the order is 120 Euro or more, the shipping is free to Slovak republic.

We would like to notice that the bank transfer between 2 banks takes up to 48 hours.

Delivery time
The seller commits to deliver the good in the shortest time possible depending on its availability. The delivery time varies from 7 days to 3 weeks from receiving the order or from receiving the payment. The customer commits to pay the whole price including the shipping costs. The customer becomes the owner of the goods on the day of full payment. The seller is not responsible for the late arrival of the goods caused by the post or the parcel service or for the damage of the goods caused by them. The order can be cancelled 24 hours after receiving the confirmation email.

Contract cancelation, goods return
In accordance to valid law, the customer can return the goods without a reason within 7 days of their receiving. The cancellation of the contract has to be made by email or by post, stating the date of purchase and the number of the order. This right comes from the § 12 Consumer protection act abut internet shopping (nmr. 108/2000 Zb.). The cancellation of the order afterwards is not possible. The goods have to be sent back to the seller. The customer is required to send the products back unused, complete and in the original package, which can not be damaged. The costs of the return are covered by the customer. We recommend to send the products back as an insured package. When returning the goods it is not acceptable the cash on delivery type of return. When meeting all of these conditions, the seller commits to return of the price of the goods to customers bank account (made by bank transfer) within the 14 days of receiving the products.

Final provisions
All changes of these these Terms and conditions will be posted on this website the day before their validity the latest. These Terms and conditions are valid from 1. 11. 2010.

Claims and returns
The claim right
If the product becomes defective, the customer has the right to claim it. For the correct judgement it is necessary for the product to be clean, complete and in accordance with hygiene principles. The customer has to follow the well known rules as well as the rules stated for using and caring of the products.

Place and method of claim
The claims can be made by post or email to: Mgr. Natalia Slepecka, Pod Dielom 55, Liptovsky Mikulas, 03105. 
The claimed product can be delivered by Slovak post or by courier. The letter stating the damages has to be a part of the claim, as well as the receipt or other proof of the purchase.

Sellers responsibility
The seller is responsible for ensuring that the quality of the purchased item and its performance in generality required a seller or producer described or expected, that satisfies the requirements of the legislation in quantities and to the purpose that the seller using things out or for which the case is usually used. The seller is responsible for defects that occur at the goods after their purchase within the warranty period.
Seller is not liable for errors:
- If the buyer has caused damage to himself
- If the buyer before taking goods was aware of their deficiencies
- for which it was offered a discount on the price of goods
- Incurred during the warranty period due to incorrect wear of the goods or their excessive use
- The product was mechanically damaged or destroyed by improper handling
- If the paint color is not exactly the material on the Internet, according to which the goods were purchased
- If the accuracy of the backup pattern on the fabric does not match the photograph

After receiving the claim the seller shall issue a letter of complaint stating the date on which the claim is accepted, what is the claimed goods, when and where the goods were purchased, what shortage occurred and the price at which the goods were acquired. Complaint letter will be sent to the address of the buyer by e-mail. If the buyer reclaimend defect of goods, the seller will verify the complaint and decide immediately upon receiving of the goods, in complex cases within 3 working days. Seller shall respond to complaints within a maximum of 30 days from the date of receiving the claim.

Time limits for lodging a complaint
The seller is responsible for the defects of the goods for a period of 24 months from the date of the receipt. If the claim is equipped with repair, the warranty is extended by the period from the time of the warranty claim and the date on which the consumer is required after repairs to take over the goods, even if they did not do so. If the claim is equipped with an exchange of goods for new goods was made. New warranty period shall run from the date when the goods were handed over, respectively sent to the buyer. If there is no claim of defective goods applied within the warranty period, right from liability is failing to cease. Buyers will be informed after facilitating the complaint in person, by phone or e-mail.

Owner of this shop www.jibstarshop.com therefore declares that all personal data (name, surname , telephone numbers, e-mail address and mailing or delivery address) is confidential and will only be used for internal use shop. Under no circumstances, will not be disclosed or misused . This personal information is necessary for performance of the contract and are collected only for commercial and marketing purposes .

The buyer declares that he agrees under Law no. 122/2014 Coll, The protection of personal data processed by the vendor and store their personal data while taking note of the processing of their personal data. This also gives the seller consent to the processing of personal data indefinitely. Revoke this consent to the processing of personal data by the buyer may, at any time , in writing or by telephone.

Personal data "buyer" are entered into our electronic system when making orders via electronic form or at registration. These may be further amended in the stage of order processing . Registered customer access to e-shop is protected by password, known only to registered "buyer " . We therefore ask , in their own interest not leave the password open to others, so as to prevent the abuse and then to the misuse of your personal data . For the misuse of a password vendor assumes no responsibility.
